1. Acceptance of Terms

By accessing or using FeedbackFlow.AI, you agree to:

• Comply with these Terms and our Privacy Policy
• Be at least 18 years old or have parental consent to use the service
• Have the authority to upload and process student work through our platform

If you do not agree to these Terms, you may not use our service.

2. Description of Service

FeedbackFlow.AI provides:

• AI Transcription: Convert handwritten student essays to digital text using Google Gemini API
• AI Marking & Feedback: Generate marking suggestions and feedback based on your mark schemes
• Student Management: Organize students, classes, and assignments
• Credit-Based Usage: Purchase credits to use AI features (no subscription required)

3. User Responsibilities

As a user of FeedbackFlow.AI, you are responsible for:

3.1 Data Protection & Consent

• Obtaining necessary permissions to upload student work to our platform
• Ensuring compliance with your school/institution's data protection policies
• Obtaining parental consent for students under 16 (where required by law)
• Understanding that student essays will be processed by Google's Gemini AI service (as detailed in our Privacy Policy)

3.2 Account Security

• Maintaining the confidentiality of your account credentials
• Notifying us immediately of any unauthorized access
• All activities under your account are your responsibility

3.3 Accuracy of Information

• Providing accurate profile information
• Reviewing and verifying all AI-generated transcriptions and feedback
• Ensuring uploaded content is appropriate for AI processing

4. Prohibited Uses

You may not use FeedbackFlow.AI to:

• Upload illegal, harmful, or offensive content
• Violate copyright, privacy, or other intellectual property rights
• Upload content containing hate speech, harassment, or discrimination
• Attempt to hack, reverse engineer, or compromise the security of our service
• Resell or redistribute access to our service without authorization
• Use automated systems (bots, scrapers) to access the service in ways not intended
• Abuse our support systems or submit false reports

We reserve the right to suspend or terminate accounts that violate these prohibitions.

5. Intellectual Property

5.1 Your Content

• Student work remains the property of students/schools
• You retain all ownership rights to content you upload
• By uploading content, you grant us a license to process it solely for providing the service (transcription, marking, storage)
• We do not claim ownership of your data

5.2 Our Platform

• The FeedbackFlow.AI software, design, branding, and features are protected by copyright and trademark laws
• You may not copy, modify, or create derivative works without permission
• Our name, logo, and trademarks may not be used without authorization

6. Credits & Payment

6.1 Credit System

• AI features require credits (tokens) which you purchase through Stripe
• Credits are consumed based on AI usage (transcription, marking)
• Credit prices are displayed at purchase and may change with notice

6.2 Refund Policy

• Used credits are non-refundable (they represent consumed AI processing)
• Unused credits do not expire while your account remains active
• If you believe you were incorrectly charged, contact us within 14 days

6.3 Payment Processing

• All payments are processed securely through Stripe
• We never see or store your credit card details
• Stripe's terms of service also apply to transactions

7. Service Availability

We strive to provide reliable service, but:

• We do not guarantee 100% uptime or uninterrupted access
• Maintenance may be performed with or without notice
• Third-party services (Google Gemini, Stripe) may affect availability
• We are not liable for data loss due to service interruptions (keep backups of important work)

8. Limitation of Liability

FeedbackFlow.AI is provided "as is" without warranties of any kind.

8.1 What We Are NOT Liable For

• AI Accuracy: Incorrect transcriptions, marking errors, or inappropriate feedback suggestions
• Data Loss: Loss of data due to user error, browser issues, or force majeure
• Third-Party Failures: Issues caused by Google Gemini, Stripe, Supabase, or Cloudflare
• Consequential Damages: Lost productivity, missed deadlines, or other indirect damages
• Educational Outcomes: We are a tool, not a substitute for professional teaching judgment

8.2 Maximum Liability

Our maximum liability for any claim is limited to the amount you paid us in the last 12 months, or £100 (whichever is greater).

9. AI-Generated Content Disclaimer

Important information about our AI features:

• Transcriptions are AI-generated and may contain errors (especially with difficult handwriting)
• Marking and feedback suggestions are AI-generated and may not perfectly align with your expectations
• Teachers must review all AI output before sharing with students or using for official grading
• AI cannot replace professional educator judgment and expertise
• We continuously improve AI accuracy but cannot guarantee perfection

10. Termination

10.1 By You

• You can delete your account at any time via Settings
• Upon deletion, all your data is removed per our Privacy Policy
• Unused credits are forfeited upon account deletion

10.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent activity
• Your account is inactive for 2 years (after email notification)
• Required by law or legal process

10.3 Effect of Termination

• Access to the service is immediately revoked
• Data is deleted according to our retention policy (30-day archive, then permanent deletion)
• No refunds for unused credits

11. Data Processing & Privacy

By using our service, you acknowledge:

• Student essays are processed by Google's Gemini API for transcription and marking
• Data is stored on EU servers (Supabase) with appropriate security measures
• We comply with GDPR and UK data protection laws

12. Changes to Terms

We may update these Terms from time to time:

• Significant changes will be communicated via email
• Continued use after changes constitutes acceptance
• If you don't agree with changes, you may delete your account
• The "Last Updated" date reflects the current version

13. Governing Law & Disputes

These Terms are governed by the laws of England and Wales.

2. Mediation: We're open to mediation for unresolved disputes
3. Jurisdiction: Courts of England and Wales have exclusive jurisdiction
